General Terms of Trade and Delivery (valid as of march 15th,  2012)

Ambit

Our general terms and conditions apply to all business relations between apimanu  and the customer. General terms and conditions apply at their version valid at  the time of the order. Special conditions requested by the customer require the approval of apimanu.

Conclusion of contract

All of our special offers are not-binding. A contract between apimanu and the customer is concluded, when the order placed by the customer has been accepted and confirmed by apimanu. The order of the customer is to be placed by filling out and transmitting the provided order form via internet. apimanu sends acceptances of the order by e-mailing confirmation of the order to the customer. apimanu is neither obliged to accept the offer, nor to process the order, in case there is writing errors or legal mistakes in the website.

Delivery

Product, that is in stock (we are not liable for transportation problems), is ready for dispatch . In case the product is not in stock, we take great effort to deliver as soon as possible. In case of breach of delivery terms which are due to higher power, labor dispute, unpredictable obstacles or other circumstances, the time for delivery will be extended adequately. In case of breach of delivery terms due to other reasons than mentioned above, the customer may set an adequate extension of delivery time accompanied by a threat of refusal. In case the extended delivery date did expire also, the customer becomes entitled to withdraw from the contract agreement. If the impossibility of the delivery is based on incapacities by the manufacturer or our supplier, apimanu as well as the customer may withdraw from the contract, provided that the arranged date of delivery has exceeded 2 months. In case the customer already had paid for the product, we will give her/him a refund promptly. Claims for compensation due to delay or impossibility or non-fulfillment, also those that occur in association with a withdrawal from the contract, are impossible. This regulation applies, unless a lawful representative of the firm "apimanu" has acted intentionally or coarsely negligently.
Unfortunately, we cannot influence possible delays of delivery caused by the parcel delivering company, hence are not reliable for their delays. The delivery is performed to the delivery address provided by the orderer. Our gift service offers to you: Shipping of product to the gift recipient and mailing of the bill to the orderer. Is the product ordered by you not available with us, we will inform you promptly. We do not deliver to the following countries: Iran, Iraq, Afghanistan, Lybia, Sudan. This applies also to diplomatic orders.

Retention of title

The product remains our property until completion of payment process.

Office Hours

Our corporate and shipping offices are open from 8am to 6pm Monday through Friday and are closed Saturday and Sundays. Our shipping office closed on all government observed holidays as well as on weekend.

Shipping Policies

We use Parcel Services exclusively for all shipping. Business days are Monday through Friday and on non-government observed holidays. Weekends are Saturday and Sundays. Under normal circumstances, orders placed will ship the following business day. Orders placed on the weekend will ship at the next earliest business day which is usually the following Monday.

International Deliveries

Customs restrictions and warranty issues prevent us from shipping to every international location. Customers are responsible for any additional customs fee. We can not ship overnight to international addresses.

Undeliverable Packages

All undeliverable packages returned to us are issued a refund minus shipping and return costs . In such a case, we charge 15 Euro. We can not re-ship orders that return to us as undeliverable. Customers are welcome to re-order the products again.

Order Fulfillment

We strive to fulfill your order correctly and quickly. In order to maintain the best service to our customers, we have several guidelines in our order processing.

Cancellations

Cancellations must be made innert 24 hours. If the product has not shipped, a refund will be issued by the same method of payment the order was originally charged. If a cancellation is placed after 24 hours, latest after the order is shipped, we will not issue a refund.

Returns

In accordance with the relevant law of the European Union (E.U.) medical products, pharmaceuticals, nutrition supplements, vitamins and other capsuled or tabletted items are excluded from returns.

International Orders

A:  If your order is to be shipped outside Countries of the European Community,  the delivery time varies between 7 to 14 business days but is usually much closer to 7 days. If your order is to be shipped into Countries of the EU, the delivery time is between 2 and 5 days.
B:  Do NOT order items that are illegal to import into your country. Laws vary from country to country. It is your responsibility to check with your Customs office to see if your country permits the import of our products. Generally speaking, we have never encountered problems with customs when shipping to most countries worldwide.
C:  If the package is seized by Customs for any reason, we will NOT issue you a refund. Most orders held by customs is for the purpose of charging import duties and VAT. We have had such troubles in less than 1% of our international shipments. If you are not sure, please contact the Customs Office in your country before ordering, as we are not responsible for such charges.

Payment

Payment must be done by credit card. Please take a note, that due to the introduction of the Anti Money Laundering Regulations 2007, it is a legal requirement, that we only accept verified Credit Card and verified wire transfer payments. (bank-to-bank). We neither accept cash payments nor PayPall, WorldMoney,WesternUnion or equal payment methods. Each payment has to be definitely verified by the personal data of the payer. We reserve the right to refuse payments and business relationships, if we/or our bank can not recognize/verify the uniqueness of the transfer of funds. We do NOT accept payments from IRAN, IRAK, SYRIEN, AFGHANISTAN, LYBIA and  SUDAN. (We were never ask to do that, but we inform customer just in case, they decide to do so.)

Shipping costs

Depending to the purchase price, we charge different fee for the shipment world-wide.  For deliveries to Countries in the EU, we charge 4,60 EUR. For countries outside the EU States there is an additional fee for customs declaration of 5 Euro per order (not per item). Have a look to our section "internal shipping fee" on our web site.
We do NOT deliver to the following countries: IRAN, IRAK, SYRIEN, AFGHANISTAN, LYBIA and  SUDAN. (We were never ask to do that, but we inform customer just in case, they decide to do so.)
Court of juristiction
For commerce with merchants and juridical persons of the public right, the court state for legal disputes is arranged for in Gibraltar.
For concerns of end users, the residence court of the end user is also responsible for contractual disputes.
For end user concerns regarding consumer rights, the right to use residence court is applicable.

Final regulations

In case particular regulations of these general terms of trade should not be applicable, the remaining regulations ARE yet effective. The relevant lawful regulation supersedes the ineffective regulation.
